Managing Challenges in Transit : Cargo Damage, Foreign Proceedings by Line, and Sellers' Options

My recent article in the magazine "iMelange" analyses the legal options available to cargo exporters in India in case foreign proceedings are initiated against them concerning a claim by an international shipping line that was contracted for carriage. The case study is from an actual issue faced by an Indian exporter however all reasonable care to maintain privacy and confidentiality of the parties have been taken as the foreign proceedings are in progress. The article presents a general discussion on the above topic based upon the facts available in the case at hand however the specific legal advice may vary as per the facts and circumstances of each case.
