Unreasonable Conduct Is Negligence

As mentioned by the Hon'ble Madras High Court in Value Shipping v Owners and parties interested in MV Nadhenu Purna, Application Nos.138 and 479 of 2024 in C.S.(Comm.Div.)No.4 of 2024 at Para 39:

"The reasons for seeking extensions of the cancellation date by the owners of the defendant vessel, on a prima-facie consideration, reveal the

negligence on the part of the owners of the defendant vessel to take required measures to obtain requisite permissions from the Classification Society and other Statutory Authorities. Therefore, the owners of the defendant vessel cannot shirk its responsibility by blaming either the classification society or the statutory authorities for its failure to obtain all the necessary permissions on time."

I've attached the summary of the above judgment, as I could do so to my best, pronounced on 08.02.2204 by the court as published in the iMelange March 2024 edition.

Prathamesh Kamat, thanks for publishing the judgment.
